Peer Insight, LLC (“Peer Insight,” “we,” “us,” or “our”), doing business as Creative Refresh, operates the Creative Refresh service (the “Service”) — a mobile-first creative self-care experience for family caregivers accessible at creativerefresh.org and delivered in part via SMS text messaging.

By accessing or using the Service in any manner, whether automated or otherwise, you agree to be bound by these Terms of Use, our Privacy Policy, and any additional terms that may apply to specific features of the Service.

We reserve the right to modify these Terms of Use at any time. Continued use of the Service after we post any changes will constitute your acceptance of the updated Terms of Use.

Creative Refresh is a creative self-care experience designed for family caregivers. The Service includes:

• A mobile-first web application with a curated library of creative self-care activities
• SMS nudges and activity recommendations
• AI-assisted conversational responses to text messages
• A community feed where participants can share their experiences
• A user profile and activity tracking experience

The Service is offered for personal, noncommercial use only. Some features may be available only to enrolled pilot participants.

Research Context: This Service is part of a pilot research initiative sponsored by AARP. Your participation may contribute to research findings shared with AARP in aggregated, de-identified form. This Service is operated by Peer Insight, LLC and is not an AARP product or service.

The Service, including all wellness content, creative activity suggestions, and SMS messages, is offered for informational and personal enrichment purposes only to support caregiver wellbeing.

Nothing in the Service should be considered, or used as a substitute for, medical advice, diagnosis, or treatment.

Activity Risk Notice: Creative activities suggested through the Service are intended as light, accessible ideas for personal enrichment. All activities are undertaken at your own risk. Peer Insight is not responsible for any physical injury, discomfort, or harm that may result from participating in any suggested activity.

Our Intellectual Property

The Service and all materials contained within it — including activity content, text, images, and software — are the property of Peer Insight, LLC and/or its licensors, and are protected by copyright, trademark, and other intellectual property laws.

We grant you a nonexclusive, nontransferable, limited right to access and use the Service for your personal, noncommercial use. You agree not to assign, transfer, or sublicense your rights.

You agree that you will not use any content from the Service in connection with data mining or the development, training, testing, or operation of any artificial intelligence or machine learning system or model without our prior written permission.

Your License to Us

By posting or submitting any material to the Service you represent and warrant that you are the owner of the material or have the owner’s consent to use it. When you submit or post material, you grant Peer Insight the royalty-free, perpetual, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, distribute, and display it worldwide.

By providing your phone number and consenting at signup, you agree to receive text messages from Creative Refresh including account verification links, SMS nudges and activity recommendations, responses to text messages you send to the Service, and occasional program updates.

Message frequency varies based on your preferences and interactions with the Service.

Reply STOP to cancel. You will receive one final confirmation and will no longer receive texts from the Service.

Message and data rates may apply depending on your mobile carrier plan.

Carriers are not liable for any delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support of services, such as customer service, is permitted. Text messaging originator opt-in data and consent will not be shared with any third parties.

By using the Service you represent and warrant that:

• You are at least 16 years of age
• You have the legal capacity to agree to these Terms of Use
• You will provide true, accurate, current, and complete information about yourself
• You will maintain the accuracy of your information and update it as necessary
• You will use the Service only for lawful purposes and in accordance with these Terms of Use
• You will not use the Service in any way that violates applicable laws or regulations

The Service includes a community feed and other interactive features that allow you to share text, images, and other content with other participants. You are responsible for any material you post through the Interactive Features.

These Interactive Features shall be used for lawful purposes only and to support a safe, warm, and supportive community for caregivers. You agree not to post false, misleading, defamatory, offensive, or harmful content, or to impersonate others or use the features for commercial solicitation.

You may not access or use the Service for any purpose other than that for which it is made available. As a user of the Service you agree not to:

• Use the Service for any unauthorized or unlawful purpose
• Use any robot, spider, web crawler, or other automated device to monitor or copy the Service without our prior written permission
• Attempt to gain unauthorized access to the Service or any account, computer system, or network connected to the Service
• Use the Service to transmit unsolicited communications
• Harass, abuse, or harm another person through use of the Service
• Use content from the Service to develop, train, or operate any artificial intelligence or machine learning model without our prior written permission
• Collect or harvest personal information of other users
• Circumvent, disable, or otherwise interfere with security-related features of the Service

The Service may allow you to submit, post, or share content including text messages, activity reflections, images, and community feed posts (“Contributions”). You are solely responsible for your Contributions.

By making Contributions you represent and warrant that you own or have the rights to submit the Contribution, and that your Contribution does not infringe the rights of any third party or contain false, misleading, or harmful content.

By submitting Contributions to the Service you grant Peer Insight a worldwide, royalty-free, perpetual, irrevocable, nonexclusive license to use, reproduce, modify, adapt, publish, distribute, and display your Contributions for purposes of operating and improving the Service and for research and reporting in aggregated or de-identified form.

You retain ownership of your Contributions.

We reserve the right — but have no obligation — to monitor the Service for violations of these Terms of Use, take appropriate legal action, refuse or restrict access to contributions or features, and otherwise manage the Service in a manner designed to protect our rights and the rights of users.

These Terms of Use remain in full force and effect while you use the Service. We reserve the right to deny access to the Service to anyone who violates these Terms of Use or who, in our sole judgment, interferes with the ability of others to enjoy the Service or infringes the rights of others.

If we terminate or suspend your account for any reason, you are prohibited from registering a new account under your name or a false name.

We reserve the right to change, modify, or remove the contents of the Service at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Service without notice.

We will not be liable to you for any modification, suspension, or discontinuation of the Service.

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia without giving effect to any principles of conflicts of law.

Informal Negotiations

To expedite resolution and reduce the cost of any dispute, controversy, or claim related to these Terms of Use, the parties agree to first attempt to negotiate informally for at least thirty (30) days before initiating arbitration. Such informal negotiations commence upon written notice from one party to the other at hello@creativerefresh.org.

Binding Arbitration

If informal negotiations fail to resolve a Dispute, the Dispute shall be finally and exclusively resolved through binding arbitration. The arbitration shall be initiated through the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Restrictions

Arbitration shall be limited to the Dispute between the parties individually. No arbitration shall be joined with any other proceeding, and there is no right for any Dispute to be arbitrated on a class-action basis.

THE INFORMATION, CONTENT, AND SERVICES OFFERED ON OR THROUGH THE SERVICE ARE PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE PURSUANT TO APPLICABLE LAW, PEER INSIGHT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

WE MAKE NO WARRANTIES THAT ANY CREATIVE ACTIVITY SUGGESTED THROUGH THE SERVICE IS SAFE, APPROPRIATE, OR SUITABLE FOR YOUR INDIVIDUAL PHYSICAL CONDITION OR CIRCUMSTANCES. ALL ACTIVITIES ARE UNDERTAKEN AT YOUR OWN RISK.

UNDER NO CIRCUMSTANCES, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, SHALL PEER INSIGHT, LLC, ITS AFFILIATES, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT FROM THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You understand and agree that you are solely and personally responsible for your behavior on the Service. You agree to indemnify, defend, and hold harmless Peer Insight, LLC, its affiliates, licensors, employees, agents, and any third-party service providers from and against all claims, losses, expenses, damages, and costs resulting from or arising out of your use, misuse, or inability to use the Service, or by any violation of these Terms of Use by you.

This Service operates as a research pilot sponsored by AARP under a Statement of Work between AARP and Peer Insight, LLC. By using the Service you acknowledge and agree that:

• Your participation may contribute to research findings shared with AARP in aggregated, de-identified form
• Peer Insight, LLC is solely responsible for the operation of the Service during the pilot period
• This Service is not an AARP product or service and AARP is not responsible for its operation
• The pilot program may be modified, paused, or discontinued at any time
• Your data handling is governed by the Creative Refresh Privacy Policy operated by Peer Insight, LLC

These Terms of Use constitute the entire agreement between Peer Insight and you with respect to the Service and supersede all previous and contemporaneous agreements, proposals, and communications, written or oral.

If any provision of these Terms of Use is found unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
